1. Agreement to Terms

By accessing or using Monk India ("we", "us", or "our") application or website, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, then you may not access the service. These Terms govern your use of the Monk India platform, dedicated to providing gym management services.

2. Services Provided

Monk India provides software tools for gym owners to manage memberships, track payments, send automated reminders, and view analytics related to their facility ("Services"). A stable internet connection is required to backup data to our cloud servers and access our online payment portals.

3. User Accounts

• When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.
• You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Gym Member Data

You represent and warrant that you have obtained all necessary consents and authorizations from your gym members to input their personal data, including contact numbers, into the Monk India application for the purpose of managing their memberships and sending transactional or reminder messages.

5. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as annually), depending on the type of subscription plan you select. All payments made through the web portal are processed securely via our third-party payment partner (Razorpay).

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Monk India and its licensors. The Service is protected by copyright, trademark, and other laws of India.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Limitation of Liability

In no event shall Monk India, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
